Terms of Service
The agreement between you and Fadi Kanaani for using DevScan AI.
1. Who we are and what these terms cover
DevScan AI (the "Service", available at https://devscanai.com) is operated by Fadi Kanaani, Al-hor, Kafr Qara, Israel, Israel ("we", "us"). These Terms of Service ("Terms") govern your use of the Service. By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Acceptable Use Policy.
If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.
You must be at least 18 years old (or the age of majority where you live) to use the Service.
2. The Service
DevScan AI tests websites and web applications with automated checks — functionality, performance, accessibility, SEO, mobile layout, security configuration, APIs and, where permitted, load — explains the results, can generate prompts for AI coding tools, and can retest to compare results.
DevScan AI never changes your code or your website. Any change you make based on our results or AI-generated prompts is your decision and your responsibility.
We may improve, change or discontinue features. If we remove a material feature of a paid plan during a paid period, we will tell you in advance and you may cancel and request a pro-rata refund for the unused period.
3. Your account
Provide accurate information and keep it up to date. Keep your password and two-factor codes confidential; you are responsible for activity under your account. Tell us immediately at [email protected] if you suspect unauthorized access.
Workspace owners decide who is invited to their workspace and what role each member has, and are responsible for their members' use of the Service.
4. Authorized testing only
You may only scan, monitor or test websites, APIs and systems that you own or that you have explicit permission from the owner to test. Each time you start a scan you confirm this authorization, and we keep a record of that confirmation.
Load tests are only allowed on domains whose ownership you have verified in the Service, and only within the published presets. Load tests send real traffic to the target; you are responsible for informing your hosting provider where its terms require it and for any costs on your side.
Optional login flows and API checks may use credentials or tokens you provide. Only provide credentials for test accounts you are allowed to use. We store them encrypted and use them only to run the checks you configure.
Full rules are in our Acceptable Use Policy. Breaking them can lead to immediate suspension (section 10).
5. Plans, trials and payment
Paid plans and add-ons are sold by our reseller and Merchant of Record, Paddle.com (Paddle). Paddle processes your payment, issues invoices, collects applicable sales tax/VAT and handles refunds on our behalf; Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms) apply to your purchase. We never see or store your full card details.
Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel. You can cancel at any time in Billing; you keep access until the end of the period you have paid for, and you will not be charged again.
Upgrades take effect immediately and are charged pro rata. Downgrades take effect at the next renewal. Nothing is deleted when you downgrade: projects above the new plan's limit become read-only.
Free trial: new accounts may start one restricted Pro trial (14 days, no payment details required). When it ends, the workspace returns to the Free plan unless you choose a paid plan.
Usage limits (scans, AI prompts, monitors, load-test credits, team members) are part of each plan and enforced automatically. Unused allowances do not roll over. One-off add-ons apply to the billing period in which they were bought.
We may change prices for future billing periods with at least 30 days' notice by email. If you do not agree, you can cancel before the change takes effect.
Refunds: see our Refund Policy.
6. Your content and data
You keep all rights to the websites you test, the information you enter and the results produced for you ("Your Content"). You give us a limited permission to store and process Your Content only to provide, secure and support the Service for you.
Scan results are automated observations of publicly reachable pages (and of the systems you authorize). You are responsible for having the right to test those systems and for any credentials you provide.
You can export your account data and delete projects or your whole account at any time in Settings. How long we keep data is described in our Privacy Policy.
We may use aggregated, de-identified statistics (for example, the number of scans run or the most common issue types) to operate and improve the Service. These never identify you, your websites or your results.
7. AI features
AI fix prompts and summaries are generated automatically, either from fixed templates or, when enabled, with the help of an AI model provider. Before any data is sent to an AI provider we remove secrets such as passwords, tokens, cookies and API keys.
AI output can be incomplete or wrong. Review AI-generated prompts and any code changes made with them before using them in production, and retest afterwards.
8. No guarantees about results
Automated testing finds many common problems but cannot prove the absence of defects, security vulnerabilities, accessibility barriers or performance problems, and can report false positives. A good score is not a certification that a website is secure, accessible, compliant (for example with WCAG, GDPR or PCI DSS) or able to handle a certain amount of traffic. Security checks are passive configuration checks, not a penetration test.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We aim for high availability but do not guarantee uninterrupted service; planned maintenance is announced where possible.
9. Limitation of liability
To the extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) our total liability arising out of or relating to the Service in any 12-month period is limited to the amount you paid us for the Service in those 12 months (or USD 100 if you used only free plans).
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you also keep any mandatory rights given to you by the law of the country where you live.
10. Suspension and termination
You can stop using the Service and delete your account at any time.
We may suspend or terminate your access immediately if you break these Terms or the Acceptable Use Policy, if your use creates a security or legal risk, harms other people or systems, or if required by law. Where reasonable we will tell you why and give you a chance to fix the problem first. If we terminate a paid plan without cause, we will refund the unused part of the prepaid period.
After termination you can no longer use the Service; data is deleted as described in the Privacy Policy. Sections that by their nature should survive (for example 6, 8, 9, 11 and 12) continue to apply.
11. Indemnity
If you are a business user, you will defend and indemnify us against third-party claims arising from websites or systems you tested without authorization, from credentials or content you provided unlawfully, or from your breach of the Acceptable Use Policy.
12. Intellectual property
The Service, its software, design, documentation and the DevScan AI name and logo belong to Fadi Kanaani or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. Do not copy, resell, reverse engineer or build a competing product from the Service.
If you send us feedback or ideas, we may use them without obligation to you.
13. Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the Service at least 30 days before they take effect. If you keep using the Service after the effective date, you accept the updated Terms; if you do not agree, cancel before that date.
14. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. Disputes will be handled by the competent courts of Haifa District, unless mandatory consumer law gives you the right to bring a claim in the courts where you live. Please contact us first — most problems can be solved quickly.
